The Robbins Equitas Local Government and Municipal Law Practice Group represents cities, towns, and counties and their elected officials. We are experienced in defending the claims commonly made against local government and its leaders. This is an especially active and litigation-prone area of law that requires counsel to be nimble, smart, and assertive.
Local Government and Municipal Law
Advisory and Transactional Services:
- Review, revise, or draft proposed local ordinances, resolutions, and other rulemaking devices
- Provide advisory opinions on legal questions to elected and appointed officials
- Determine whether proposed or existing ordinances are constitutional
- Negotiate and review contracts and other transactions between local governments
- Representation of local governments during municipal board meetings, including commission meetings, code enforcement meetings, and other volunteer boards
- Drafting policies and procedures, employment handbooks, hiring and retention practices, and other services
- Provide presuit assessment in matters involving alleged violations of constitutional rights asserted by prisoners and other parties
Litigation Services:
- Represent public officials who are wrongfully sued
- Defend challenges to ordinances, government action, and local regulations
- Defend claims brought by government employees for employment discrimination and alleged state and federal fair labor statute violations
- Defend the government in 42 U.S.C. § 1983 cases brought in federal court by prisoners and other parties alleging violations of constitutional rights by the local government, prison officials, and police
- Defend government and elected and appointed officials from claims alleging constitutional violations and alleged civil rights violations
- Defend sheriffs and police following allegations of brutality or alleged prisoner mistreatment
- Defend cases involving contests relating to zoning and planning issues as well as highway and street design defect claims
- File and prosecute in rem foreclosure actions and condemnation actions
